TERMS AND CONDITIONS

IMPORTANT NOTICE

Ymax Plus is designed to be used with the user's own created content or created playlists with legal content.
Ymax Plus Application only displays the content added by the User and plays the User Content in the player.
Ymax Plus does not provide any content or playlists.
Ymax Plus allows the users to load content from their IPTV playlist or play the playlist available at Xtream Codes API.
Ymax Plus Application is available on the Apple Store, and Google Play Store.

INTRODUCTION

Thanks for choosing Ymax Plus. Ymax Plus provides an advanced IPTV player for the Android and iOS platforms for playing your own content i.e., Videos and streams.

By signing up or otherwise using the Ymax Plus that is made available through our Website, Play Store, App Store, or anyhow available to you, you understand and agree you have entered into an Agreement with Ymax Plus.

Your agreement with us includes these Terms and any additional terms that you agree to, as discussed in the Entire Agreement section below, other than terms with any third parties (collectively, the “Agreements”). The Agreements include terms regarding future changes to the Agreements, privacy policy, disclaimers on the mobile applications, limitations of liability, privacy, waiver of class actions, and resolution of disputes by arbitration instead of in court(s).

Acknowledge that you have read and understood the Agreements, accept these Agreements, and agree to be bound by them. If you don’t agree with (or cannot comply with) the Agreements, then you must not access and/or use Ymax Plus.

In order to use the Ymax Plus and access any Content,

You need to be 18 years or older, or 13 years or older, and have your parent or guardian’s consent to the Agreements.
You need to have the power to enter an Agreement with us and not be barred from doing so under any applicable or governing laws. You also promise that any registration information that you submit to Ymax Plus is true, accurate, and complete, and you would notify Ymax Plus in case of a change in any information so provided.

Ymax Plus APPLICATION

Ymax Plus is available for free and you can only watch your own content i.e., videos, and streams with ads at zero cost. It is important to note that we do not provide any content whatsoever. Technical issues could occur in technology products and we may interrupt the access to Ymax Plus for any maintenance or improvements to the player. You may be notified of such upgrades or maintenance by Ymax Plus. Features included in this version:

CONCEPT OF ACTIVATION CODE

Unlike other IPTV players, Ymax Plus follows the concept of activation code for users to access their IPTV playlist.
The activation code concept allows users to generate a code from our official website, which grants them access to their IPTV playlist content on Ymax Plus. This approach enhances user-friendliness and simplifies the player's usage.

CHANGES TO THE AGREEMENTS

We shall reserve the right at its sole discretion, to modify, amend or replace these Agreements. Occasionally we may make changes to the Agreements. When we make material changes to the Agreements, we may provide you with notice as appropriate under the circumstances, e.g., by displaying a prominent notice within the Application or by sending you an email. In some cases, we will notify you in advance, and your continued use of our product after the changes have been made will constitute your acceptance of the changes. Therefore, please make sure you read any such notice carefully.

If you disagree with the revised terms of use then you may discontinue the use of service.

COPYRIGHT INFRINGEMENT

Ymax Plus respects the intellectual property rights of others and expects Users to do the same. Ymax Plus does not own or provide any IPTV content. The Ymax Plus Application is solely intended for playing IPTV streams provided by the User. Ymax Plus does not store, host, or distribute any copyrighted content, including IPTV streams. Ymax Plus acknowledges that it serves as an intermediary platform, facilitating access to user-generated IPTV data. As such, it is challenging to monitor each individual file on the platform for potential copyright violations.

Ymax Plus recognizes the importance of addressing copyright infringements and has established a comprehensive procedure to respond to reported cases of copyright violations. We take instances of copyright violations very seriously and are committed to addressing them promptly.

Ymax Plus expeditiously handles reported cases of copyright infringement. Upon receiving a valid DMCA notification, Ymax Plus will take appropriate actions.

USER-GENERATED CONTENT

You are solely responsible for all the Content that you play or stream or access. Ymax Plus is not responsible for the Content you access nor does it endorse any opinion present in any Content. YOU AGREE THAT IF ANYONE BRINGS A CLAIM AGAINST Ymax Plus OR ITS AFFILIATES, RELATED TO USER CONTENT THAT YOU ACCESS, THEN, YOU ARE ONLY SOLELY RESPONSIBLE FOR THE CONTENT YOU ACCESS AND NOT Ymax Plus, AND TO THE EXTENT PERMISSIBLE UNDER LOCAL LAW, YOU WILL INDEMNIFY AND HOLD Ymax Plus HARMLESS FROM AND AGAINST ALL DAMAGES, LOSSES, AND EXPENSES OF ANY KIND (INCLUDING ATTORNEY FEES AND COSTS) ARISING OUT OF SUCH CLAIM.

RIGHTS YOU GRANT US

In consideration of the rights granted to you under the Agreements, you grant us the right to allow the Ymax Plus to use the processor, bandwidth, and storage hardware on your Device to facilitate the operation
Aside from the rights specifically granted herein, you retain ownership of all rights, including intellectual property rights, in the User Content. Where applicable and permitted under applicable law, you also agree to waive and not enforce any “moral rights” or equivalent rights, such as your right to be identified as the author of any User Content, including Feedback, and your right to object to derogatory treatment of such User Content.

USER GUIDELINES

Ymax Plus respects all laws and agreements and intellectual property rights and expects you to do the same. You must follow these rules and should encourage other users to do the same.

The following is not permitted for any reason:

Use the Application to do anything that is illegal or which may be deemed illegal in the territory where you are using our application.
Using the Application for watching, streaming, broadcasting, publicly making available, performing, displaying to the public, recording, transferring, reproducing, copying, or redistributing content which is not expressly permitted under the Agreements or applicable law or which otherwise infringes the intellectual property rights (such as copyright) of Ymax Plus, any person, or any entity.
Transferring copies of cached third-party Content from an authorized Device to any other Device via any means.
Reverse-engineering, disassembling, modifying, or creating derivative works of the Ymax Plus Application or any part thereof except to the extent permitted by applicable law;
Circumventing any technology used by Ymax Plus, its licensors, or any third party to protect the Application.
Selling, renting, sublicensing, or leasing of any part of the Ymax Plus Application;
Circumventing any territorial restrictions applied by Ymax Plus or its licensors;
Removing or altering any copyright, trademark, or other intellectual property notices contained on the Application or provided through the Application (including disguising or changing any indications of the ownership or source of any Content);
Providing your password to any other person or using any other person’s username and password;
“Crawling” the Ymax Plus Application or otherwise using any automated means (including bots, scrapers, and spiders) to view, access, or collect information from Ymax Plus or the Ymax Plus Application.
Selling a user account or otherwise accepting or offering to accept any compensation, financial or otherwise, to influence the name of an account or the content included on an account or playlist or Artificially promoting Content by automated means or otherwise.

Please respect Ymax Plus, the owners of the Content, and other users of the Ymax Plus Application. Don’t engage in any activity, post any User Content, or register and/or use a username, which is or includes material that:

is offensive, abusive, defamatory, pornographic, threatening, or obscene.
is illegal, or intended to promote or commit an illegal act of any kind, including violations of intellectual property rights, privacy rights, or proprietary rights of Ymax Plus or a third party.
includes your password or purposely includes any other user’s password or purposely includes personal data of third parties or is intended to solicit such personal data.
includes malicious content such as malware, Trojan horses, or viruses, or otherwise interferes with any user’s access to the Application.
is intended to or does harass or bully other users.
impersonates or misrepresents your affiliation with another user, person, or entity, or is otherwise fraudulent, false, deceptive, or misleading.
involves the transmission of unsolicited mass mailings or other forms of spam, junk mail, chain letters, or similar.
involves commercial or sales activities, such as advertising, promotions, contests, sweepstakes, or pyramid schemes, that are not expressly authorized by Ymax Plus.
links to, references, or otherwise promotes commercial products or services, except as expressly authorized by Ymax Plus.
interferes with or in any way disrupts the Ymax Plus Application, tampers with, breaches, or attempts to probe, scan, or test for vulnerabilities in the Ymax Plus Application, or any of Ymax Plus’s security components, authentication measures, or any other protection measures applicable to the Application, or any part thereof.
conflicts with the Agreements, determined by Ymax Plus.
You acknowledge and agree that posting any User Content that violates these User guidelines (or that Ymax Plus reasonably believes violates these User guidelines) may result in immediate termination or suspension of your Ymax Plus account. You also agree that Ymax Plus may reclaim your username for any reason.
Ymax Plus has no responsibility for your choices to view/watch material on the Application or the content you watch on the Ymax Plus Application.

Your password protects your user account, and you are solely responsible for keeping your password confidential and secure. You understand that you are responsible for all use (including any unauthorized use) of your username and password on the Application. If your username or password is lost or stolen, or if you believe there has been unauthorized access to your account by a third party, you must notify us immediately and change your password as soon as possible.

SERVICE LIMITATIONS AND MODIFICATIONS

Ymax Plus will make reasonable efforts to keep the Ymax Plus Application operational. However, certain technical difficulties, maintenance or testing, or updates required to reflect changes in relevant laws and regulatory requirements, may, from time to time, result in temporary interruptions. Ymax Plus reserves the right, periodically and at any time, to modify or discontinue, temporarily or permanently, functions and features of the Ymax Plus Application, with advance notice where possible, all without liability to you, except were prohibited by law, for any interruption, modification, or discontinuation of the Ymax Plus Application or any function or feature thereof.

The Company does not guarantee that the data and other information provided through the Software are accurate or will be in compliance with applicable copyright laws, except for data and information that is directly created or prepared by the Company.
The Company is not responsible for any losses or damage incurred to the user due to the installation, use, or non-use of the Software except where such losses or damages are caused by the willful misconduct or gross negligence of the Company.
The Company is not responsible for any loss of actual or anticipated profits of the user from their use of the Software.
The Company is not responsible for, and will not be obligated to be involved in, any disputes that arise between users and between a user and a third party in connection with their use of the Ymax Plus Application.

TERM AND TERMINATION

The Agreements will continue to apply to you until terminated by either you or Ymax Plus. However, you acknowledge and agree that the perpetual license granted by you about Feedback is irrevocable and will therefore continue after the expiry or termination of any of the Agreements for any reason. Ymax Plus may terminate the Agreements or suspend your access to the Ymax Plus Application at any time, including in the event of your actual or suspected unauthorized use of the Ymax Plus Application, or non-compliance with the Agreements, or if we withdraw the access to the Application (in which case we shall provide you with reasonable notice in advance of doing so). If you or Ymax Plus terminate the Agreements, or if Ymax Plus suspends your access to the Ymax Plus Application, you agree that Ymax Plus shall have no liability or responsibility to you, and Ymax Plus will not refund any amounts that you have already paid, to the fullest extent permitted under applicable law. You may terminate the Agreements at any time. This section will be enforced to the extent permissible by applicable law.

Sections 7, 8, 9, 11, 15, 16, 17, 18, 19, 20, 21, 22, and 23 herein, as well as any other sections of the Agreements that, either explicitly or by their nature, must remain in effect even after termination of the Agreements, shall survive termination.

THIRD-PARTY RIGHTS

You acknowledge and agree that the owners of the Content and certain distributors (such as app store providers) are intended beneficiaries of the Agreements and have the right to enforce the Agreements directly against you. Other than as set out in this section, the Agreements are not intended to grant rights to anyone except you and Ymax Plus, and in no event shall the Agreements create any third- party beneficiary rights. Furthermore, the rights to terminate, rescind, or agree to any variation, waiver, or settlement of the Agreements are not subject to the consent of any other person.

If you have downloaded the App from the Apple, Inc. (“Apple”) App Store or if you are using the App on an iOS device, you acknowledge that you have read, understood, and agree to the following notice regarding Apple. This Agreement is between you and Ymax Plus only, not with Apple, and Apple is not responsible for the Application and the content thereof. Apple has no obligation whatsoever to furnish any maintenance and support services concerning the Application. In the event of any failure of the Application to conform to any applicable warranty, then you may notify Apple and Apple will refund any applicable purchase price for the App to you; and, to the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever concerning the Application. Apple is not responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of the Application, including:

Product liability claims.
Any claim that the Application fails to conform to any applicable legal or regulatory requirement.
claims arising under consumer protection or similar legislation. Apple is not responsible for the investigation, defense, settlement, and discharge of any third-party claim that the Application and/or your possession and use of the App infringe that third party’s intellectual property rights. You agree to comply with any applicable third-party terms when using the Application Apple, and Apple’s subsidiaries, are third-party beneficiaries of this Agreement, and upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary of this Agreement. You hereby represent and warrant that
1. You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country.
2. You are not listed on any U.S. Government list of prohibited or restricted parties.
